Welcome to RedFlag - Detector ("Service", "App", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and related services.

By creating an account, downloading our app, or accessing our service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you are using our Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

RedFlag - Detector is an AI-powered relationship analysis tool that helps users identify potential toxic patterns, manipulation, and warning signs in text-based conversations.

The Service includes:

• AI-powered conversation analysis using GPT-4 and Claude AI models
• Detection of 6 types of red flags: manipulation, contradiction, disrespect, jealousy, control, and toxicity
• Risk scoring and detailed analysis reports
• Free tier: 3 analyses per week using GPT-4o mini
• Premium tier: Unlimited analyses with Claude 3.5 Sonnet (€7.99/month)
• Multi-language support (English, French, Spanish, Portuguese)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

You must be at least 18 years old to use RedFlag - Detector. By using our Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under any applicable laws
• All information you provide to us is accurate and current

4.1 Account Creation
To use certain features of the Service, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4.2 Free Tier
Our free tier provides 3 conversation analyses per week using GPT-4o mini. Usage limits reset every Monday at 00:00 UTC.

4.3 Premium Subscription
Premium subscribers receive:

• Unlimited conversation analyses
• Access to Claude 3.5 Sonnet AI model for enhanced accuracy
• Priority support
• Advanced analysis features

4.4 Billing and Payment
Premium subscriptions are billed monthly at €7.99/month. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are subject to change with 30 days notice.

4.5 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months, except as required by law or at our sole discretion.

5.1 Privacy-First Approach
Your privacy is our top priority. We implement industry-standard encryption and security measures to protect your data. For detailed information about how we collect, use, and protect your information, please review our Privacy Policy.

5.2 Conversation Data
Conversations you submit for analysis are:

• Encrypted in transit and at rest
• Processed in real-time by our AI models
• Not stored permanently on our servers
• Never shared with third parties except as required for AI processing (OpenAI, Anthropic)
• Automatically deleted after analysis completion

5.3 Third-Party AI Services
We use OpenAI (GPT-4) and Anthropic (Claude) for AI-powered analysis. These services process your conversation data according to their respective privacy policies and data processing agreements.

You agree NOT to:

• Submit conversations containing illegal content or content that violates others' rights
• Use the Service to harass, stalk, threaten, or harm others
• Submit conversations involving minors
• Attempt to circumvent usage limits or payment requirements
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated systems (bots, scripts) to access the Service
• Resell, redistribute, or commercially exploit the Service without authorization
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Impersonate others or provide false information

Violation of these terms may result in immediate termination of your account and legal action.

7.1 Our Content
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and AI models, are the exclusive property of RedFlag - Detector and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content
You retain ownership of any conversations you submit to the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to process your conversations solely for the purpose of providing analysis services.

7.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without any obligation to you.

8.1 Not Professional Advice
IMPORTANT: RedFlag - Detector is an educational and informational tool. It is NOT a substitute for professional advice from licensed therapists, counselors, psychologists, or legal professionals.

• Analysis results should not be considered medical, psychological, or legal advice
• The Service does not establish a doctor-patient or therapist-client relationship
• For serious concerns about abuse, manipulation, or safety, please consult qualified professionals
• In emergency situations, contact local authorities or crisis hotlines immediately

8.2 AI Limitations
Our AI-powered analysis, while advanced, has limitations:

• AI may produce false positives or miss certain patterns
• Context and nuance may not always be fully captured
• Results should be used as one factor among many in relationship evaluation
• Human judgment and professional guidance remain essential

8.3 Service "AS IS"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Analysis results will be accurate, complete, or reliable
• Any errors or defects will be corrected
• The Service will meet your specific needs or expectations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REDFLAG - DETECTOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Actions or content of third parties using the Service
• Any reliance on analysis results provided by the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless RedFlag - Detector, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any content you submit to the Service
• Your breach of any representations or warranties

11.1 By You
You may terminate your account at any time by contacting support or using in-app account deletion features.

11.2 By Us
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Requests by law enforcement or government agencies
• Unexpected technical issues or security concerns
• Extended periods of inactivity
• Any reason at our sole discretion

11.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. We may delete your account and all associated data. Sections that by their nature should survive termination shall survive, including ownership, disclaimers, indemnity, and limitations of liability.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website or app. We will notify you of material changes via:

• Email notification to your registered email address
• In-app notification
• Notice on our website

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

It is your responsibility to review these Terms periodically for changes.

13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to first attempt to resolve disputes informally by contacting us.

13.3 Jurisdiction
For any disputes that cannot be resolved through arbitration, you agree to submit to the exclusive jurisdiction of the courts located in France.

14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RedFlag - Detector regarding the Service.

14.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 No Third-Party Benefits
These Terms do not create any third-party beneficiary rights.
